Terms of Service

1. The Services

Cahndu connects creators, clubs, ambassadors, brands, and event organizers to run ambassador, referral, UGC, and affiliate campaigns. Cahndu also offers the Cahndu Shop, where anyone can browse gear picked by creators and clubs, follow them, save favorites, and build shareable Packs. Some features are in early access and may change, be interrupted, or be discontinued at any time. Joining the waitlist does not guarantee access to the platform.

2. Eligibility and Accounts

You must be at least 18 years old to create an account. You agree to provide accurate information, keep your credentials secure, and be responsible for activity under your account. Shopper accounts may sign in through a one-time link sent to your email address; anyone with access to that inbox can use the link, so keep it secure. We may suspend or terminate accounts that violate these Terms.

3. Your Content

You retain ownership of content you submit through the Services (photos, videos, posts, profile information). You grant Cahndu a non-exclusive, worldwide, royalty-free license to host, display, and distribute that content as needed to operate the Services. Where you participate in a campaign, additional content-use terms between you and the brand, club, or event organizer may apply as disclosed in that campaign. You are responsible for having the rights to any content you submit.

4. Campaigns, Referrals, and Rewards

Campaign terms, reward amounts, and payout eligibility are set by the sponsoring brand, club, or event organizer and displayed in each campaign. Referrals must come from genuine promotion; self-referrals, spam, incentivized clicking, and fraudulent activity will void rewards and may result in account termination. Payouts are processed through third-party payment providers and may be subject to their terms and to tax reporting requirements.

5. The Cahndu Shop and Affiliate Links

Cahndu does not sell, ship, or warrant any product shown in the Cahndu Shop. Product links take you to third-party retailers, brands, or affiliate networks, and any purchase is a transaction between you and that seller under its own terms, prices, shipping, and return policies. Prices, availability, and product details are supplied by those sellers and may change or be inaccurate; check them on the seller's site before you buy.

Creators, clubs, and Cahndu may earn a commission when you buy through a link, code, or recommendation on the Services. Recommendations reflect the personal picks of the creator or club that posted them, not an endorsement by Cahndu. Packs, favorites, and follows that you choose to share are visible to anyone with the link.

6. Acceptable Use

You agree not to misuse the Services, including by violating laws, infringing intellectual property, misrepresenting sponsorships or endorsements, failing to make legally required advertising disclosures (such as FTC disclosure of material connections), generating clicks, favorites, follows, or purchases artificially, scraping or reverse-engineering the platform, or interfering with its operation.

7. Third-Party Services

The Services may link to or integrate with third-party platforms, including social media networks and registration providers. Your use of those services is governed by their own terms, and we are not responsible for them.

8. Intellectual Property

The Services, including the Cahndu name, logo, design, and software, are owned by Cahndu LLC and protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, or create derivative works from the Services.

9. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Cahndu does not organize or operate races, events, or adventures listed by third parties and is not responsible for them, including their safety, quality, or cancellation. Cahndu is not responsible for products bought from third-party sellers through the Cahndu Shop, including their quality, safety, delivery, or returns.

10. Limitation of Liability

To the maximum extent permitted by law, Cahndu LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability for any claim arising out of the Services will not exceed the greater of $100 or the amounts you paid us in the twelve months before the claim.

11. Indemnification

You agree to indemnify and hold harmless Cahndu LLC and its officers, members, and employees from claims arising out of your content, your use of the Services, or your violation of these Terms.

12. Termination

You may stop using the Services at any time. We may suspend or terminate your access at any time for violation of these Terms or to protect the Services. Sections that by their nature should survive termination will survive.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law rules. Any dispute arising out of these Terms or the Services will be resolved exclusively in the state or federal courts located in Utah, and you consent to their jurisdiction.

14. Changes to These Terms

We may update these Terms from time to time. We will post the updated version here and revise the effective date above. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
